This workshop builds on the NZLS CLE workshop Mediation for Lawyers Part A which provided opportunity to understand the process of mediation and to learn to think like a mediator – not a lawyer. It provides further opportunity to observe a mediation, to dissect it and to practise mediation skills – this course will be run in streams according to candidates’ preferences. Finally participants will be involved in a moderated assessment exercise – where they will go on learning but also be the mediator whose performance is being assessed. The assessment, carried out by an experienced mediator, involves reflection and a written report.

Learning objectives

You will be able to:

  • Recognise how to apply appropriate strategies to progress a mediation.
  • Identify how important the right questioning is to assist parties toward resolution.
  • Recognise how to apply techniques to handle emotion, manage power imbalance and to break impasse.
  • Practise a mediation in a safe environment, with feedback.
  • Identify, through reflection, your strengths and areas for improvement in your mediation practice exercise.

Who should attend

This course is for lawyers who have attended the Mediation for Lawyers Part A (or are exempted by reason of previous mediation training) and who wish to:

  • Increase their experience and understanding in civil/commercial, family or education dispute mediation
  • Add civil/commercial, family or education dispute mediation to their legal practice
  • Attain a Massey University and NZLS CLE Certificate of Achievement.

This workshop runs from Friday evening until 5.00pm on Sunday. For the first two days a range of techniques will be used to demonstrate, discuss and practise skills. The Sunday will be almost entirely taken up with assessment exercises. Registrants must be present for the whole day. Places are strictly limited.

Before the workshop you will be sent, for prior review, the course materials which include a folder, and the text Mediation Skills and Strategies. All participants also need to be thoroughly conversant with the coverage from the Part A workshop and the course text Mediation: Principles, Process and Practice. If you have been exempt from Part A you must be familiar with the course text and earlier materials. Please tick the boxes on the registration form, as required.
