Presentation time: 90 minutesIt may come as a surprise to learn that, although it is rare, it is possible to claim both interim and substantive spousal maintenance from an estate. This webinar will highlight the different considerations that come into play for a spousal maintenance claim against executors/administrators.
The webinar will also set out the steps to take to ensure your client actually gets paid once they have an Order for spousal maintenance.
This webinar will take a two-pronged approach:
The first part will consider applications for spousal maintenance against an estate, particularly interim spousal maintenance. Practical tips will be given of the different considerations that come into play when reviewing an applicant’s budget and their overall claim for spousal maintenance against an estate. This comes out of a recent decision which was the first to address this remedy and has not been well understood or well utilised.
The webinar will also provide advice to executors/administrators of an estate to assess an application or a potential claim for spousal maintenance.
The second part will consider the practical steps required to enforce a spousal maintenance Order in the event a respondent refuses to pay.
