Natural Justice in Employment - 1 CPD hour

  • Publication date: April 2016
  • Authors: Andrew Scott-Howman

Tribunals in the employment jurisdiction are required to adhere to the principle of natural justice and maintain procedural fairness. More recently, this obligation has been placed upon employers - especially around workplace investigations.

Ensuring a full and fair investigation of allegation is vital to this process. How do you achieve this whilst acting consistently with the obligations of natural justice?

This module will look at the steps that you can take to ensure your interactions with your client are not biased and that you meet your obligation to hear from both sides.

Other issues to be looked at are:
  • What are the key differences between natural justice and procedural fairness?
  • How do you ensure you’ve met your duty to hear from both sides?
  • What should you put into the report to meet your obligations?
  • When you draft the report will you be questioned about its contents?
  • What other potential issues are there?

The Blurred Lines Between an Employee's Work & Private Life - 1 CPD hour

  • Publication date: June 2015
  • Authors: Tim Cleary, Samantha Turner

Cell phones, selfies, social networking sites, “friends” and being an employee can be a problematic mix. An employee’s private life is often not so private especially when lived online.

“Out-of-work” conduct may be scrutinised by employers, whether that is pre, during or post-employment. It may be failing to disclose previous convictions or other behaviours outside of the workplace becoming public.

By looking at recent developments and core principles, Samantha and Tim will discuss how an employee’s out-of-work conduct can/does impact on their employment situation.

This module will cover:
  • Modern workplaces
  • Statutory considerations
  • Evidential aspects
  • Pre-employment conduct
  • Out of work conduct
  • Conduct discovered after employment ends
  • Health and safety aspects.

This module is based on the successful presentation at the 2014 NZLS CLE Employment Law Conference.

Workplace Bullying - new guidelines - 1 CPD hour

  • Publication date: September 2014
  • Author: Susan Hornsby-Geluk, Ros Webby

Workplace bullying is currently in the spotlight following the recent release of WorkSafe New Zealand’s guidelines on the subject. But how have the guidelines, written for lay persons, changed the way in which workplace bullying should be addressed by practitioners? What do legal practitioners need to be aware of in advising on, investigating or litigating alleged bullying? What will be the likely effect of the first real attempt in New Zealand at a universal definition of the concept, and how will that impact on established case law?

This webinar will address the practical and legal implications of the way in which bullying allegations should be progressed in light of the guidelines’ release. It will explore the extent to which they may change or modify how the Authority and Court ultimately deal with them.
