Section 44 of the Property (Relationships) Act 1976 enables the disposition of property to be clawed back when the transfer was made in order to defeat the claimant’s rights under the PRA.

This webinar will consider key developments in this area, including trust busting when you do not have a marriage, analysis of the issues emerging from case law and the practical implications for your clients.

Topics covered will include the:
  • Impact of the Regal Castings and Ryan v Unkovich on the wording “intention to defeat”
  • Necessity for evidence, or at least knowledge, of a potential claim for success under s 44
  • Extent to which independent advice may become necessary when property is transferred to a trust during, or in contemplation of, a qualifying relationship.
