Following on from a session at the Auckland CPD Top-Up Day in February this year, this seminar will provide an update on the latest issues pertaining to residential property transactions. This update will include consideration of issues associated with; unit titles, tax, disclosure by vendors including representation as to leaks, real estate agents as vendors or purchasers, the Land Transfer Act 2017, and the Overseas Investment Amendment Bill.

This seminar will include:
  • A discussion of issues associated with unit titles; including pre-contract and pre-settlement disclosure statements
  • A discussion of tax issues involved in residential sale and purchase
    - outline of residential land withholding tax
    - implications for offshore persons
    - an update on the Bright Line test
  • A discussion of the vendor requirements for disclosure
    - representation as to leaks
    - disclosure of town planning issues
  • An outline of the complications when Real Estate Agents are vendors or purchasers; will discuss s 136 of the Real Estate Agents Act 2008
  • An overview of the Land Transfer Act 2017
  • An update on the Overseas Investment Bill
    - discussion of how some residential properties may be still available to overseas buyers
  • Case law on the issues that may arise when giving notice to tenants.

Matthew Tetley-Jones WEB EDIT Matthew Tetley-Jones

Matthew graduated from the University of Auckland and was admitted to the bar in 1988. He worked in civil , family and criminal litigation in his early days, first with McVeagh Fleming and then as a barrister in the 1990s. In 2000, Matthew joined Tetley-Jones Thom Sexton, then under the leadership of his father Maurice Tetley-Jones. He continued as a general litigator and appeared as junior counsel in Ladstone Holdings Limited v Leonora Holdings Limited [2006] NZLR 211, a case dealing with alleged misrepresentation in relation to the sale of land.

In 2006, Matthew moved into transactional work and took over as principal at Tetley-Jones Thom Sexton. In 2011, he joined McVeagh Fleming as a partner. Matthew now deals with sale and purchase of land, property law, trusts, wills, relationship property, elder law and occasionally a bit of intellectual property.

He no longer appears in court as counsel but has been a defendant, in his capacity as executor in a Family Protection Act case – Webb v Tetley-Jones [2014] NZFC 1036.
