Costs are an issue which invariably confront almost every civil litigator, and although they are considered in virtually every case, they continue to pose unexpected and, at times, difficult questions. This seminar will provide you with an overview of the general principles underpinning costs and also adopt a practical focus in considering some specific and recent issues in this area.

This seminar will include:

  • A brief overview of the general principles of costs in civil litigation
  • Guidance on applications for indemnity costs and for reduced costs
  • Consideration of the relevance of actual costs against scale costs (when indemnity costs are not payable)
  • A discussion of the rule that litigants in person are not entitled to recover costs except in exceptional cases and the current position of lawyer-litigants
  • Consideration of some of the practical implications when security for costs are required
  • An outline of Sanderson and Bullock orders; what these are and when they can be used
  • A brief discussion regarding enforcement of costs awards, particularly on interlocutory applications
  • Practical tips on applications for costs.

Rowan is an experienced advocate in civil and regulatory matters. He has been a Barrister Sole since September 2011 and has practised as a litigator for more than 15 years. Rowan has experience in a wide variety of cases including shareholder & property disputes; trust and estate litigation; and professional negligence claims. He is a panel prosecutor for the Office of the Crown Solicitor, Manukau.
