The Health and Safety at Work Act came into effect on 4 April 2016 and introduced fundamental changes to the law including duties being framed around a “person conducting a business or undertaking”, increased penalties and the imposition of a positive duty of due diligence on officers. The presenters will outline some of the key developments flowing from this new legislation, the themes emerging from recent cases and also consider the implications for practitioners on a practical level.

This seminar will include:
  • A discussion of employer duties, including real life scenarios to illustrate new obligations under the Act
  • What leads to charging documents being filed. This will cover:
    - what to do after receiving WorkSafe’s investigation report
    - practical tips on what to do if prosecuted
    - enforceable undertakings as an alternative to prosecution
  • The sentencing process. This will include:
    - key developments & trends in sentencing decisions
     -awards of future economic loss
    - effect of insolvency
    - multiple PCBUs and co-defendants – how does the court approach sentencing in these cases
    - recent cases, including lessons from Australian case law.

Learning objectives

By attending this seminar you will gain:

  • Greater understanding of employers health and safety obligations under the Health and Safety at Work Act 2015, and the potential consequences that arise from breaching the Act.
  • Knowledge of what to do if a charging document is filed by WorkSafe, and the process which follows.
